How do i set up a student contract on Salary.lu?

If you’re an employer in Luxembourg and want to hire a student during school holidays or the academic year, you need to set up a specific student work contract (“contrat d’occupation d’élève/étudiant”).


1. Determine the Type of Contract


A. Student work contract (vacation work)


  • For students aged 15–26 (must not have turned 27) enrolled in full-time education or who left within the last 4 months
  • Valid only during school holidays
  • Maximum duration: 2 months or 346 hours per calendar year


B. Fixed-term student contract during the academic year


  • CDD (contrat à durée déterminée) for students attending school during term.
  • Weekly working time capped at 15 h per week (averaged monthly to 60 h).
  • No weekly cap during holidays, but annual limit still applies.



2. Drafting the Contract


These contracts must be in writing, created individually no later than the first working day, and produced in triplicate (employer, student, ITM).


Include the following mandatory details:


  1. Student’s full name, date of birth, address
  2. Employer’s name & address
  3. Start and end dates (format dd/mm/yyyy)
  4. Work location
  5. Job description
  6. Daily & weekly working hours
  7. Wage payment terms
  8. Accommodation provided, if applicable


All copies must be signed. If not formalized in time, the student’s status may default to an indefinite contract (CDI).



3. Salary & Social Security


Minimum wage:

  • ≥ 80% of the age-adjusted national minimum wage


Social security:

  • Student must be registered with the CCSS, but only accident insurance is required; no health or pension contributions


Tax withholding:

  • For hourly wages ≤  16€, employers can apply for a wage tax withholding exemption
  • If >  16€/hr, standard withholding tax rules apply; the student needs a tax card



4. Submitting the Contract to ITM


Within 7 days of the start date, submit:


  • The third contract copy
  • A copy of the student’s ID


This can be done by mail or via MyGuichet.lu



5. Working Hours & Leave


  • Vacation contract (≤2 months/year or 346 h): Weekly hours capped by holiday schedule, Sundays and public holidays are allowed for minors 
  • CDD during term: Weekly average ≤ 15 h and ≤ 60 h/month; holiday weeks exempt from these limits
  • Leave: Students do not receive the full 26 days of annual leave but may be eligible for unpaid special leave



6. Health & Safety Requirements


  • Medical check: Mandatory only for high-risk jobs.
  • Under-21s or minors: Provide written instructions and risk information before work begins.



7. Create the Contract on Salary.lu


To register a student contract on Salary.lu, follow these steps:


  1. Log in to your Salary.lu account.
  2. Go to the “Employees” section and create the student’s profile.
  3. Open the profile and navigate to the “Contract” tab.
  4. Select “Student” as the contract type.
  5. Fill in the required information such as start and end dates, working hours, and wage details.
  6. If applicable, enter the job code 560 for student employment.
