How do I set up HORECA-specific regulations on Salary.lu?

This article explains how to configure HORECA sector-specific labor regulations for your employees, including public holiday work, Sunday work compensation, and night work premiums.



Enabling HORECA sector regulations


To activate HORECA-specific regulations for an employee:


  1. Log in to your Salary.lu account
  2. Go to the employee's profile
  3. Open the "Contract" tab
  4. Check the box "Employee in HORECA sector" under contract options
  5. Save the contract details


Activate this setting for each HORECA employee to ensure compliance.



Public holiday work compensation


For HORECA businesses operating on public holidays, employees can receive one of three compensation options:



Compensation options


  • 2 paid rest days within 6 months per public holiday worked, OR
  • 2 additional paid vacation days added to regular annual leave, OR
  • 1 paid half day of rest per week throughout the year



Adding compensation manually


  1. Go to the employee's contract details
  2. Scroll to the "Options" section
  3. Check the box "Additional leave"
  4. Specify the additional number of days


You must manually track and add these compensation days for each employee who works on public holidays.



Sunday work compensation


HORECA employees follow special Sunday work rules that differ from standard labor regulations.



No Sunday wage premium


  • HORECA employees do not receive the standard 70% wage premium for Sunday work
  • Instead, they receive compensatory rest and potential extra leave days



Compensatory rest entitlements


  • More than 4 hours on Sunday: Full day of compensatory rest
  • 4 hours or less on Sunday: Half day of compensatory rest
  • All compensatory rest is paid at 100% of normal wages



Extra paid leave for frequent Sunday work


  • If an employee works at least 20 Sundays per year, add 2 extra days of paid leave (manually via contract options)


Keep detailed records of all Sunday hours and compensation.



Night work regulations and premiums


Night work in the HORECA sector has specific time definitions and compensation requirements.



Night work definition


  • Night work: Any work performed between 23:00 and 06:00
  • Night workers cannot exceed 8 hours per 24-hour period on average (calculated over 7 days)



Night work premiums


  • 01:00 to 06:00: 25% wage increase (cash or compensatory leave)
  • 23:00 to 01:00: No mandatory premium unless specified by agreement



Ensure regular medical check-ups for night workers and maintain exemptions for pregnant or breastfeeding women.


Record-keeping requirements



HORECA employers must maintain special registers documenting:

  • Sunday hours worked and compensation provided
  • Night work hours and additional payments
  • Public holiday work and rest days granted
  • Medical check-up records for night workers


These records must be available for labor inspection at all times.


Employment of teenage students (between 15 and 18 years) is not subject to the same rules as adult employees regarding night, Sunday, or public holiday work. Night work is generally prohibited for teenagers, and Sunday or public holiday work is only allowed in exceptional cases with prior authorization.
